Paul and Rosa Myles filed a complaint on August 14, 2026, in the U.S. District Court for the Northern District of California against Genomic Prediction Inc. and NextGen Genetics (doing business as Luminary Genetics), alleging medical negligence and product defect related to genetic embryo testing.

The couple underwent in vitro fertilization (IVF) as part of their fertility treatment. As part of this process, they elected to use preimplantation genetic testing for aneuploidy (PGT-A), a screening procedure in which cells are biopsied from embryos at the blastocyst stage and tested for chromosomal abnormalities to identify which embryos may be suitable for transfer to the uterus.

According to the lawsuit, the defendants' testing machine malfunctioned and produced inconclusive results for both of the Myleses' embryos. Because the initial results were inconclusive, both embryos had to be thawed and biopsied a second time. The couple's highest-graded embryo did not survive the second thaw. Testing of the remaining embryo later revealed an abnormal number of chromosomes, leaving the couple with no viable embryos to transfer. The Myleses claim the defective machine directly caused the loss of their embryos and prevented them from proceeding with their fertility treatment.
