On July 4, 2026, a family gathered on a stationary pontoon boat on Herrington Lake in Kentucky was struck head-on by a 2017 Axis watercraft operated by Cody Casey of Mercer County. According to the complaint filed in Mercer Circuit Court (Case No. 26-CI-00267), Casey was performing erratic maneuvers including repeated "donuts" at an excessive rate of speed on a crowded lake when he accelerated toward the family's boat despite their attempts to signal him. Family members were both on the boat and in the surrounding water at the time of the collision.

The complaint alleges that Casey fled the scene without rendering aid or providing identification, in violation of Kentucky law. The lawsuit asserts claims for negligence, gross negligence, failure to render aid under KRS 235.250, and seeks punitive damages. The plaintiffs have demanded a jury trial. Peterson Law and Whiteford Taylor & Preston, collaborating on the case, are representing the injured family members and indicated they seek to hold the defendant fully accountable.
