The case was removed to U.S. District Court for the District of Nevada on August 6. Mendoza claims the defendant failed to disclose health risks and side effects, instead marketing kratom as a safe herbal supplement despite its highly addictive and opioid-like properties.

Kratom is derived from the leaves of the Mitragyna tree native to Southeast Asia and is sold in various forms including powders, capsules, extracts, and beverages through gas stations, smoke shops, convenience stores, and online retailers. The substance interacts with brain receptors targeted by opioids such as morphine and heroin. The FDA has not approved kratom for any use.

The complaint alleges that Nova Kratom failed to adequately warn consumers about the numerous health risks and side effects associated with kratom consumption.
